Terms & Conditions

These terms and conditions apply to the Phone Tracker app (hereby referred to as "Application") for mobile devices that was created by Yehor Siholaiev (hereby referred to as "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.

Use of the App and its Functions

Our app uses GPS technology to help you locate and keep track of your family members, friends, and loved ones in real time on a live, private map. With our app, you can easily add members by sharing a unique 6-digit invite code. Once they accept, you'll be able to view their current location and location history on the map at any time.

Subscriptions and charges

The cost and type of subscription are available to users in the App. The subscription is purchased through the Apple payment system. Apple App Store rules regulate refund orders for subscription purchases. Learn more about refunds on the Apple App Store here.

Trial period. Some of our subscriptions include a free trial period, where you can experience the app at no cost. A subscription with the free trial period will automatically renew to a paid subscription once your free trial expires. If you decide to unsubscribe from a paid subscription before Apple starts charging your payment method, cancel the subscription before the free trial ends.

Automatic renewal. Payment will be charged to your credit/debit card through your Apple App Store (Apple ID) account. You choose one of our subscriptions and confirm your purchase. Paid subscriptions automatically renew unless auto-renew is turned off or canceled 24 hours before the renewal date in the Manage Subscriptions section of your account settings. Disclaimer

Your use of the software is at your sole risk. The software is provided on an "AS IS" and "AS AVAILABLE" basis. The software is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We  don’t warrant that the software will function uninterrupted, secure, or available at any particular time or location;

• any errors or defects will be corrected;
• the software is free of viruses or other harmful components or
• the results of using the software will meet your requirements.

Some jurisdictions don’t allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

User guarantees

By using or visiting our App, you guarantee the following:

• the compliance with age restrictions;
• that you will use the app for personal use;
• that you have all the powers (competence and legal capacity) required by law to accept these terms.
• that you will not use the software for fraud, other atrocities, insults defaming the honor and dignity of other users, distributing obscene content, distributing pornographic content, unapproved collection, process, and distribution of personal data of other users;
• not to violate the terms and conditions established by this agreement;
• not to violate the rights of other users, including but not limited to the intellectual property rights of third parties.
• that you will not pass malicious software.

App Rules

By using our App, you agree to comply with the rules outlined in this document, including but not limited to the following prohibited activities.

You're not supposed to:

• use the service for fraudulent activities;
• threaten, humiliate, harass, harm the reputation, and insult other users, your customers, and counterparties; violate the rights of other users, as well as persons who are not users of the service;
• create more than one account;
• collect, process, and distribute personal data of other users;
• transfer logins and passwords from your account to third parties;
• impersonate other users and publish content that does not belong to you;
• use the service to cause harm to third parties;
• perform any other actions that contradict Estonian, EU, legislation, international legislation, as well as moral values and common sense;
• upload viruses or other malicious code or otherwise violate the security of the service;
• hack, guess passwords to user accounts;
• use the service to sell sexual services;

We have the right to delete, restrict access, or block content or the account as a whole for non-observance of the terms and conditions in this document.

Location Tracking and Consent

Our app strictly requires user consent for any location-sharing features. You may only access another user's location after they have explicitly agreed and added you using a personal invite code.

You are prohibited from attempting to track or monitor individuals without their knowledge and consent. Any misuse of the app for unauthorized surveillance or tracking may result in account termination and may violate applicable laws.

By using this app, you agree to:

• Use the location-tracking feature only with individuals who have voluntarily shared their access code with you.
• Not use the app for harassment, stalking, or any form of surveillance without consent.

Sharing Consumption Information with Apple

By using our services, you acknowledge and agree that, in the event you request a refund for a consumable in-app purchase or an auto-renewable subscription, we may share certain consumption information with Apple to assist in their refund review process. This information may include details about your usage, delivery status, and playtime. We will only share this data with Apple if you have provided clear, affirmative consent. You have the right to withdraw your consent at any time. If you choose to withdraw consent, we will cease sharing your consumption information with Apple for refund evaluation purposes. Any changes in how we collect, use, or share this data will require us to seek your renewed consent. If you do not provide or withdraw your consent, this will not impact your ability to request a refund, but it may affect how Apple evaluates your request.

Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
